These Terms of Service ("Terms") govern your participation in the Host‑Smarter Referral Rewards Program ("Program"). By enrolling or sharing referral links, you agree to these Terms.
1. Eligibility
- You must hold an active Pro or Gold Host‑Smarter account in good standing.
- All plan holders are eligible to earn referral credits.
- You must be at least 18 years old and comply with all applicable laws.
2. Enrollment
- Log in to your dashboard and visit Refer & Earn to obtain your unique referral link or code.
- Enrollment is automatic upon creation of a report of your property; no additional sign‑up is required.
3. Referral Criteria
A "Referral" is a new customer who:
- Signs up via your unique link or enters your referral code at signup
- Purchases any of the plan
4. Rewards
You earn 15% credit on each qualifying purchase:
Credits apply automatically to future Host‑Smarter invoices.
5. Payout Process
Payments are made in your selected payout method (e.g. PayPal, Stripe, or bank transfer), and subject to applicable minimum thresholds.
Rewards are paid gross, without any tax deductions or withholdings.
Host-Smarter does not issue tax documentation, such as 1099 or VAT invoices, unless explicitly required by law.
6. Taxes & Legal Responsibilities
You acknowledge and agree that:

You are solely responsible for reporting and paying any income tax, VAT, or other taxes related to your referral earnings in your country of residence or tax jurisdiction.

Host-Smarter does not act as your employer, agent, or tax representative.

Participation in this Programme does not create any employment, agency, or partnership relationship between you and Host-Smarter.

You agree to indemnify and hold Host-Smarter harmless for any tax liabilities, penalties, or claims that may arise from your failure to report or pay applicable taxes.

7. Credit Expiration & Cash‑Out
- Credits expire 12 months from the date they are issued.

Once your total unused credit balance exceeds €50, you may request a cash‑out:
- Payments disbursed quarterly via PayPal or SEPA bank transfer
- Requests must include valid payout details and tax identifiers
- We deduct any applicable fees or taxes in accordance with local law
8. Abuse & Misuse
- Self‑referrals, fake accounts, bulk uploads, or any attempt to game the Program void your credits.
- We reserve the right to suspend or terminate your Program access for suspected abuse.
9. Modification & Termination
- We may modify or end the Program at any time. Changes take effect upon posting to our site.
- Your existing referral credits remain valid under the Terms in effect at the time of issuance.
10. Data Collection & Privacy
- We collect and process only standard signup information for referrals.
- All personal data handling complies with our Privacy Policy and Data Processing Agreement.
11. Limitation of Liability
To the fullest extent permitted by law, Host‑Smarter and Senti‑Consulting are not liable for indirect, incidental, or consequential damages arising from the Program.
12. Governing Law
- These Terms are governed by French law, without regard to conflict‑of‑law principles.
- Disputes will be resolved in the courts of Annecy, France.
